EB1A申請條件
根據(jù)美國移民法(Immigration & Nationality Act)第203(b)款(1)條(A)項的定義,“杰出人才”(Alien of Extraordinary Ability,簡稱EB-1A),又稱特殊技能人才,是“具有卓越專業(yè)能力,在其領(lǐng)域中少數(shù)的頂尖人物之一(Extraordinary ability means a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor)”。根據(jù)移民法規(guī)定,杰出人才移民申請還必須同時滿足以下條件:

申請人在科學、藝術(shù)、教 育、商業(yè)、或體育領(lǐng)域里具有特殊能力,得到廣泛認可,取得很高成就,并且享有國家級或國際性的聲譽與成就,其成就和貢獻在該領(lǐng)域達到頂峰。申請人被認為是該領(lǐng)域中出類拔萃的人物之一。

申請人在獲得杰出人才綠卡后,將在美國繼續(xù)從事其領(lǐng)域內(nèi)的工作; 并且,
-
申請人的工作將會對美國社會的相關(guān)發(fā)展,帶來極大利益。
杰出人才的具體衡量標準及要求是什么
以上法律條文只提供了一個非常抽象的定義,并沒有給出“杰出人才”的具體條件和衡量標準。對于如何衡量“杰出人才”,聯(lián)邦院新推出的移民法8 CFR 204.5(h)(3)提出了從如下兩個方面的衡量標準:
用第一種標準來衡量“杰出人才”,申請人只需證明他/她曾經(jīng)獲得過一項以上的重大國際知名獎勵,僅憑此項國際知名獎勵,無須提供其它證據(jù),即可滿足杰出人才的標準,輕而易舉地移民美國。至于什么樣的國際獎項才是被移民法接受的重大國際知名獎勵,移民法并無確切定義或具體標準。一般來說,諾貝爾獎、奧斯卡獎、奧林匹克獎牌或獎杯,或國際重大發(fā)明創(chuàng)造,則可被接受為重大國際知名獎勵。
但是,并不是只有獲得諾貝爾獎或奧林匹克獎之類的重大國際知名大獎的人才算是杰出人才。移民法提供了另外一種相對寬松的衡量標準,即申請人只需符合移民法規(guī)定的十條標準中的任意三條,就可申請杰出人才移民。我所為客戶申報的大量杰出人才成功案例,都是以此種標準提出申請并獲得成功。
如果上述標準對申請人的職業(yè)不適用,申請人可以提交「類似材料」來證明申請人的成就。

申請人是否曾經(jīng)獲得過一項或一項以上的重大國際知名獎勵(a one-time achievement (that is, a major, international recognized award));

申請人是否符合移民法規(guī)定的十條申請條件中的任意三個條件(at least three of the following):

“全國性或國際性獎項”(Nationally or Internationally Award)。 在其領(lǐng)域內(nèi),曾獲得稍次一些的國家獎(不一定是美國的)或國際認可獎項,證明在該領(lǐng)域內(nèi)具有優(yōu)異成就;

“受邀請專業(yè)協(xié)會會員資格”(Invited Membership)。 此類專業(yè)協(xié)會由該領(lǐng)域的國家或國際專家評定具有杰出成就人士才能加入為會員;

“媒體的報道”(Published Material About You)。 專業(yè)刊物及主要商業(yè)出版物,或主要媒體上發(fā)表過關(guān)于此申請人及其相關(guān)工作的報道,或曾有重要媒體報道過申請者以及申請者在所屬專業(yè)領(lǐng)域內(nèi)的成就(發(fā)表文章必須包括標題、日期、作者、必要時應加以翻譯);

“評審鑒定”(Judging or Review)。 在其領(lǐng)域內(nèi),曾經(jīng)以個人或委員會成員身份擔任評審,對其專業(yè)領(lǐng)域或其它相關(guān)領(lǐng)域內(nèi)的其它人的作品進行評審鑒定;

“原創(chuàng)性的重要貢獻”(Original Contributions)。 在其領(lǐng)域內(nèi),曾經(jīng)作出過學術(shù)研究或藝術(shù)上的獨創(chuàng)、原創(chuàng)性的重要貢獻;

“學術(shù)文章”( Scholarly Articles)。 在所屬專業(yè)領(lǐng)域內(nèi)的國內(nèi)、國際刊物期刊或其它重要媒體上發(fā)表過的專業(yè)作品,如學術(shù)論文,書籍、學術(shù)文章等;

“展覽或展示”( Exhibitions or Showcases)。 在國家級或具有較高聲譽或較大影響的藝術(shù)展覽會或其他場所上,舉辦作品展覽或其他展示活動;

“領(lǐng)導作用/關(guān)鍵作用”( Leading/Critical Role)。 在工作機構(gòu)、重要專業(yè)組織、團體擔任主要領(lǐng)導或其它重要職務;

“高薪”( High Salary)。 在相關(guān)領(lǐng)域,申請人的薪資、報酬、或待遇遠遠高于其它同行;
-
“商業(yè)成功”( Commercial Success)。 在表演、藝術(shù)上獲得商業(yè)方面的成功,并通過票房收入、影片、錄音帶、錄影帶、DVD等的銷售量得到反映。
Extraordinary ability means a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor.
A petition for an alien of extraordinary ability must be accompanied by evidence that the alien has sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise. Such evidence shall include evidence of a one-time achievement (that is, a major, international recognized award), or at least three of the following:
(i) Documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;
(ii) Documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;
(iii) Published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. Such evidence shall include the title, date, and author of the material, and any necessary translation;
(iv) Evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specification for which classification is sought;
(v) Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;
(vi) Evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;
(vii) Evidence of the display of the alien's work in the field at artistic exhibitions or showcases;
(viii) Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;
(ix) Evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or
(x) Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.
If the above standards do not readily apply to the beneficiary's occupation, the petitioner may submit comparable evidence to establish the beneficiary's eligibility.
No offer of employment required. Neither an offer for employment in the United States nor a labor certification is required for this classification; however, the petition must be accompanied by clear evidence that the alien is coming to the United States to continue work in the area of expertise. Such evidence may include letter(s) from prospective employer(s), evidence of prearranged commitments such as contracts, or a statement from the beneficiary detailing plans on how he or she intends to continue his or her work in the United States.
